These Terms of Service (“Terms”) are an agreement between you and the operator of World Music Stream. By downloading, accessing, or using the App, with or without an account, you agree to these Terms. If you do not agree, please do not use the App.
World Music Stream (the “App”) is a free mobile application that lets you explore and listen to internet radio stations from around the world through an interactive 3D globe, curated tours, and social features such as sharing stations with friends. The App is operated by Peyton Freiman (“we,” “us,” or “our”).
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the App. If you are under the age of majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf.
Some features, such as Friends and your Profile, require an account. You agree to provide accurate information, to keep your password confidential, and to be responsible for all activity under your account. You may use much of the App without an account as a guest; these Terms still apply to you. You can delete your account at any time as described on our Data Deletion page.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, for your own personal, non-commercial use. You may not copy, sell, rent, redistribute, reverse engineer, decompile, or create derivative works of the App, use it to build a competing service, scrape or bulk-download data from it, interfere with its operation or security, or use it for any unlawful purpose.
The App lets you create a username, upload a profile photo, post short statuses, and send stations to friends (“Your Content”). You keep ownership of Your Content, and you grant us a worldwide, royalty-free, non-exclusive license to host, store, display, and share it as needed to operate the App and show it to the users you interact with. You are responsible for Your Content and confirm you have the rights to post it. You agree not to post or send anything that is unlawful, harassing, hateful, threatening, sexually explicit, impersonates someone else, infringes anyone’s rights, or is spam. We may remove any content and may suspend or terminate accounts that violate these Terms. To report a user or content, email us at the address below.
Radio stations in the App are listed from Radio Browser (radio-browser.info), an open, community-maintained directory of internet radio stations. We do not create, host, own, or control the stations or their streams; audio plays directly from each station’s own servers. Station content, availability, quality, and metadata are the responsibility of the stations themselves and may include material some listeners find offensive or explicit. The App may also show information from other third-party services, such as local weather and time. If you are a rights holder or station operator and want a station added, corrected, or removed, use the “Add/Delete Station” link in the App’s menu or email us, and we will review your request promptly.
If you send us feedback, ideas, or suggestions, you grant us a perpetual, royalty-free license to use them for any purpose without any obligation to you.
Our collection and use of information is described in our Privacy Policy, which is part of these Terms.
We may change, suspend, or discontinue the App, or any feature of it, at any time. We may suspend or end your access if you violate these Terms or if we stop offering the App. You may stop using the App and delete your account at any time. Sections 5 through 15 survive any termination.
The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the App will be uninterrupted, error-free, or secure, or that any station, stream, feature, or data will be available or accurate at any given time.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the App. Because the App is provided free of charge, our total liability for any claim relating to the App will not exceed fifty U.S. dollars ($50).
You agree to indemnify and hold us harmless from any claims, losses, and expenses (including reasonable attorneys’ fees) arising from Your Content, your misuse of the App, or your violation of these Terms or of anyone else’s rights.
If you downloaded the App from Apple’s App Store: (a) these Terms are between you and us, not Apple, and we, not Apple, are solely responsible for the App; (b) Apple has no obligation to provide maintenance or support for the App; (c) to the extent any warranty applies, Apple has no warranty obligation, and if the App fails to conform to an applicable warranty you may notify Apple, which may refund any purchase price (the App is free); (d) Apple is not responsible for any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims; (e) you confirm you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. Government list of prohibited or restricted parties; (f) you must comply with applicable third-party terms when using the App; and (g) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the App must also follow the Usage Rules in Apple’s Media Services Terms and Conditions.
The App is available in many countries. Stations and features may not be available, appropriate, or lawful everywhere, and you are responsible for following your local laws. Nothing in these Terms limits any rights you have under consumer protection laws in your country that cannot be waived by contract.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Except where your local law gives you the right to bring a claim where you live, any dispute will be brought exclusively in the state or federal courts located in Texas.
We may update these Terms from time to time. When we do, we will change the “Last updated” date above, and for significant changes we may also notify you in the App. Continued use of the App after changes take effect means you accept the updated Terms. These Terms replace the earlier Beta Testing Terms for all versions of the App.
