The App is a pre-release, work-in-progress product provided for testing, evaluation, and feedback. It is not a finished commercial product. Features may be incomplete, may not work as intended, may change without notice, or may be removed entirely before or after any public release.
The App is provided "as is" and "as available," without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any radio stream, feature, or piece of data will be accurate or available at any given time.
We may modify, suspend, limit, or discontinue the Beta, or any feature of it, at any time without notice or liability, and may revoke your access at any time. Nothing in these Terms obligates us to release a public version of the App, continue the Beta for any period, or preserve any data or content associated with your use.
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to participate. If you are under the age of majority in your jurisdiction, a parent or legal guardian must review and agree to these Terms on your behalf.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for testing and providing feedback. You may not redistribute, sell, reverse engineer, or create derivative works of the App, or use it for any unlawful purpose.
If you send us feedback, bug reports, or suggestions, you grant us a perpetual, royalty-free license to use and incorporate that feedback into the App or any other product, without any obligation to compensate you.
The App streams internet radio stations and related metadata sourced from third-party providers and directories. We do not own, operate, or vet the content of any individual station, and station availability, quality, and metadata accuracy are outside of our control.
Our use of information collected through the App is described in our Privacy Policy. By using the App, you also agree to the Privacy Policy.
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the App during the Beta. Because the App is provided free of charge during the Beta, our total aggregate liability will not exceed fifty U.S. dollars ($50).
The Beta may be accessed by testers outside the United States. We make no representation that the App is appropriate or legal to use in every country. If you access it from outside the U.S., you are responsible for complying with your local laws.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in Texas.
We may update these Terms as the Beta evolves. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
